1. Who we are
StudyBoom is operated by Fintenso International LLC, 7901 4th St N, St. Petersburg, FL 33702, USA. These terms apply to the StudyBoom website and app and to everything you buy there. Contact: [contact email].
2. Your account
You need an account to use StudyBoom. You must be at least [minimum age, e.g. 16] years old, or have a parent's or guardian's consent. Keep your login details safe; you're responsible for activity in your account. One account is for one person.
3. The licence (lifetime access)
- The licence is a one-time payment that unlocks StudyBoom for your account. There is no subscription for the app itself.
- “Lifetime access” means access for as long as we operate StudyBoom. If we ever discontinue it, we'll tell you at least [90] days in advance and keep exports available until then.
- The licence is personal and can't be transferred, resold or shared.
- It includes 500 BoomCoins. Further AI usage is paid with BoomCoins (section 4).
- We keep improving StudyBoom. We may change features, as long as the core of what you bought (audiobooks, summaries, captions, questions answered from your material) stays available.
4. BoomCoins
AI actions, such as generating an audiobook, a summary or an answer, are paid with BoomCoins at the price shown before the action runs. The BoomCoin terms apply.
5. Storage plans and retention
- Without a storage plan, your books, audio, transcripts and notes are kept for 60 days from creation and then deleted permanently. We warn you 7 days before.
- Storage plans (50 GB for $2.99, 500 GB for $11.99 per month, plus applicable taxes) renew monthly until you cancel. You can cancel any time with effect from the end of the paid month.
- When a plan ends, content older than 60 days is deleted after a 14-day grace period.
- If you go over your plan's storage: [decide what happens, e.g. no new uploads until you free space or upgrade].
6. Your material
- You keep all rights in what you upload. We use it only to provide StudyBoom to you.
- Upload only material you're entitled to use for your private study, such as books you own or course material you've been given. StudyBoom is for your personal study. Everything stays private to your account; there's no sharing and there are no public links.
- We don't use your material to train AI models. See the privacy policy.
- If we receive a valid copyright notice about your material, we may remove it. See copyright and takedown.
7. AI output
Narrations, summaries, answers and assessments are produced with AI models. The Lektorat checks them, but they can still contain mistakes. Check important points against your source before relying on them, for example for an exam. StudyBoom doesn't give legal, medical, financial or other professional advice.
8. Fair use
Don't misuse StudyBoom. In particular, don't:
- upload unlawful content or material you have no right to use;
- try to access other accounts, probe or overload our systems, or get around limits or payments;
- resell, share or publish StudyBoom output as a service to others.
9. Prices and payment
Prices are shown in US dollars, excluding VAT or sales tax, which is added at checkout according to your billing address. Payments are processed by Stripe. Checkout may charge in your local currency and shows that amount before you pay.
10. Right of withdrawal
If you're a consumer in the EU or the UK, you have a statutory right of withdrawal. See the withdrawal policy.
11. Refunds
BoomCoin refunds follow the BoomCoin terms. Licence refunds outside the statutory right of withdrawal: [decide the licence refund policy]. Your statutory rights are not affected.
12. Availability
We aim to keep StudyBoom available at all times, but maintenance, outages of our providers or events outside our control can interrupt it. If a generation fails, the BoomCoins held for the failed steps are released.
13. Liability
[Liability clause to be drafted by counsel. For EU consumers it must leave liability for intent, gross negligence, injury to life, body or health, and mandatory statutory liability unrestricted.]
14. Ending the contract
You can delete your account at any time in Settings. We may suspend or close an account for serious or repeated breaches of these terms, after a warning where reasonable. [Decide what happens to unused purchased BoomCoins when an account is closed.]
15. Changes to these terms
We'll tell you about changes by email at least [30] days before they take effect. Changes don't affect what you've already paid for.
16. Law and disputes
These terms are governed by the laws of the State of Florida, USA. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring claims in your local courts. [confirm venue clause]
